1 The fact that in the past Devon has had a relationship with Mr. DE
2 LA HOYA's family. Mr. DE LA HOYA's representatives have now seen to
3 it that Mr. DE LA HOYA's family members are now no longer allowed
4 to have a relationship with Devon as well. As a result, Devon is
5 suffering tremendously. He feels grossly abandoned. Recent
6 occurrences in school and on-going interaction with some of his
7 friends now suggests that Devon is rebelling. He feels as though
8 he is living in isolation - as though he lives in a plastic bubble.
9 Previously, without a sufficient appreciation of the potential fall
10 out in the future, I agreed to not disclose Mr. DE LA HOYA as the
11 child's father to the outside world rsee, paragraph 6.3 of the
12 Paternity Agreement and paragraph 5.3 of the Judgment of
13 Paternity]. Recent research has now made me realize that such
14 restrictions are void as a matter of public policy.
15 Notwithstanding, nothing in the paternity agreement or Judgment
16 suggest that Devon is under any restrictions with respect to him
17 speaking freely to anyone about his father's true identity. To
18 suggest otherwise would be a violation of public policy and Devon's
right of free speech pursuant to the United States Constitution.
70 4. Devon's complexities have now "dove-tailed" into an
21 appreciation as to why it is now so important to try to allow him
22 to live close to the standard of living of his father whether or not
23 it benefits me directly. Devon should no longer have to struggle
24 financially vis-a-vis not living in a better environment.
25 5. There are so many things that Devon can and should be
26 enjoying including, going to a better school, enjoying the
27 attributes of a nicer neighborhood and being afforded a better
28 opportunity in the future.
